Assessment of Institutional Standing in the Field of Agriculture and Rural Development

     As a part of National Program for the PCA implementation and based on the Guide developed by the European Commission, AEPLAC has elaborated a report on Agriculture and Rural Development (Chapter 11 of the Acquis). The report contains parallel analysis of agricultural and rural development policies and institutional and administrative settings in the EU and Armenia. It includes also useful information on the experiences of EU countries in terms of policy measures and instruments used in agriculture and rural development areas. The report is divided into two main parts—“Agriculture” and “Rural Development”. It is partly based on the interviews and workshops with the RA state officials and other interested entities.

   
Methodology on the harmonistion of Armenian legislation to that of the European Union

     The Republic of Armenia has embarked on the path of EU integration and has taken the model for legal, administrative and political reforms of the EU countries as a benchmark. All documents aimed at the implementation of the EU integration process (ENP Action Plan, National Programme for PCA implementation) define the measures for the harmonization of the Armenian legislation to that of the EU, which, if successfully implemented, will enable Armenia to introduce effectively functioning institutions that are in line with the EU criteria.

   
Assessment of Institutional Standing in the Field of Public Procurement

     The Report was prepared under the framework of AEPLAC activity on assessment of administrative capacities of state bodies and based on the Guide developed by the European Commission.
     The detailed assessment of the administrative capacities of the Ministry of Finance and Economy, State Procurement Agency and municipalities has been done. Particularly the Report discusses legal and institutional assumptions in the field of public procurement and gives a rather detailed evaluation of human resources of said state bodies. The Report also contains the best EU practice in the mentioned fields. The set of recommendations presented in the report will further contribute to elimination of existing gaps.

   
Report on the Assessment of Administrative Capacities in the Field of Financial Control

     As a part of National Program for the PCA implementation and based on the Guide developed by the European Commission, AEPLAC has elaborated a report on Financial Control (Chapter 32 of the Acquis).
     It contains extensive analysis of experience and existing regulations of European countries in the respective fields. The report is divided into two main parts—“Public Internal Financial Control” and “External Audit”. The Report is partly based on the interviews and workshops with the RA state officials and other interested entities. It also contains the best EU practice in the mentioned fields.

   
REPORT ON THE ASSESSMENT OF INSTITUTIONAL STRUCTURE AND ADMINISTRATIVE CAPACITIES IN THE FIELD OF SOCIAL AND EMPLOYMENT POLICY

     The Report was prepared under the framework of AEPLAC activity in cooperation with Ars Progetti on assessment of administrative capacities of state bodies (as a part of National Program for the PCA implementation) and based on the Guide developed by the European Commission.
     The detailed assessment of the administrative capacities of the social and employment policy of Armenia has been done. Particularly the Report sheds light to the issues related to situation in the EU and Armenia, regulatory framework in relation to Social and Employment Policy in the EU Aquis, as well as, difference between EU and Armenia. The Report also contains the best EU practice in the mentioned fields.

   
Report on the “European Union” Training March - June 2007

     AEPLAC has elaborated the report on the “European Union” pilot training for civil servants, conducted in March-June 2007.
     The report underlines the importance of building capacities in human resources for the better implementation of the PCA and the National Programme. It includes the basis for the initiation of the undertaken activity, the descriptive part on the logistics of the core training, the evaluation of the course, the conclusions and problems, as well as solutions and suggestions related to them.

   
Assessment of Institutional Standing in the Field of Payment Systems and Money Laundering

     The Report was prepared under the framework of AEPLAC activity on assessment of administrative capacities of state bodies (as a part of National Program for the PCA implementation) and based on the Guide developed by the European Commission.
     The detailed assessment of the administrative capacities of the Central Bank and the Financial Monitoring Unit has been done. Particularly the Report highlights the legal framework and institutional capacities (including human resources, technical base, etc.) required for the ensuring free movement of capital, as well as for combating money laundering in Armenia, as it is required by the EU relevant regulations. The Report also contains the best EU practice in the mentioned fields.

   
“Cross Analysis of the ENP Action Plan and the PCA Implementation National Plan” Report

     The core objective of this report is to contribute to a more effective and efficient implementation of the ENP Action Plan and the NP, through provision of necessary tools to the Government.
     For implementation of this activity, an in-depth study of the compliance of the ENP AP measures vis-à-vis the measures defined in the NP has been conducted. Based on the outcomes of this analysis, a set of conclusions has been presented in the report.

   
Current Status Report on the EU Integration Process of Armenia up to 15 August 2007

     The EC Delegation in Armenia requested AEPLAC to elaborate “Current Status Report on the EU Integration Process of Armenia up to 15 August 2007”. This overview provides a comprehensive account on the progress made by the Government in implementation of the reforms aimed at the EU integration.
     Thus, this Report is structured to enable presentation of a comprehensive picture on the EU integration issues, including a short macroeconomic overview; a description of ENP related issues and main developments, and a presentation of the NP and its parts. This document consists of two main thematic parts, an introductory part and the main analysis.

 
Overview of PCA Implementation as of March 2007

     The EC Delegation in Armenia requested AEPLAC to elaborate “Overview of PCA Implementation as of March 2007”. The draft document consists of four thematic parts, each presenting the current situation in specific areas. The first part provides information on the NP elaboration process, applied methodologies and approaches, its structure, as well as on ENP Action Plan. The second part provides an analysis of the progress already made in NP implementation in regard to legal, policy and institutional reforms, and defines the status of implementation of measures and the progress achieved in legal and policy approximation. The third part of the overview presents the current state of affairs in the field of evaluation of administrative capacities responsible for NP implementation. The fourth part of the overview provides an analysis of the ENP Action Plan and relevant NP measures.

 
Assessment of institutional standing in the fields of economic and monetary policies

     The report is prepared under the general framework of administrative capacities assessment of the state bodies. In the Report the current situation related to implementation of economic and monetary policies are presented. Particularly the issues connected with concentration of responsibilities of conducting monetary policy and financial supervision within one body, as well as uncertainties in elaborating and implementing economic policy in terms of responsibilities of state institutions are presented.

   
Assessment of institutional standing in the fields of competition and state aid

     The Report was prepared under the framework of AEPLAC activity on assessment of administrative capacities of state bodies (as a part of National Program for the PCA implementation) and based on the Guide developed by the European Commission.
     The detailed assessment of the administrative capacities of the State Commission for the Protection of Economic Competition of Armenia has been done. Particularly the Report sheds light to the issues related to legal authorities, financial and human resources of the Commission, competition culture as well as the role of judiciary system, which are necessary preconditions for effective implementation of competition policy in Armenia. The Report also contains the best EU practice in the mentioned fields.

   
Possible Free Trade Agreement between Armenia and the EU

     The purpose of this report is to provide the requirements of the WTO in regard of conclusion of free trade agreements, to give the description of bilateral trading system, and in particular that of the EU, as well as to present the impact of conclusion of such agreements on trade flows of FTA-partner countries.
     The report consists of seven chapters. The 1st Chapter provides the general description of free trade agreements, customs unions and partial scope agreements, as well as differences between them.

   
Assessment of institutional standing in the fields of statistics

     In the framework of evaluation of the administrative capacities AEPLAC has implemented the evaluation of Statistical sector capacities in Armenia. The report evaluates the legal base and administrative structures in Statistics and compares it with the European experience as well as gives the recommendations for improvement in the sector.
     The assessment is based on the “Guide to the main administrative structures required for implementing the Acquis”, and developed by experts from the European Commission.

   
Assessment of Institutional standing in the fields of standardisation, accreditation, conformity assessment, metrology and market surveillance

    This report gives a comprehensive picture of the situation that shall serve as a base for an assessment of the yearly results of the National Programme implementation, development of institutional infrastructure needed to support the chapter “Free Movement of Goods” of Acquis Communautaire as well as further evaluation of gaps.

   
Draft Insurance Act of Armenia

     AEPLAC assisted the Central Bank of the Republic of Armenia in drafting new Insurance Act of Armenia. The drafting process has been successfully finalised – the methodology of drafting is based on regulatory and institutional patterns of the EU (including harmonising practices of the Member States) and their implementing instruments. The main objectives of draft Law is to protect the rights of policyholders, insured persons and beneficiaries, ensure the sustainable development of the insurance system, its reliability and smooth operation, as well as create equal conditions for free economic competition between entities undertaking insurance activities. The draft Law: (a) introduces the classification system of insurance activities as provided for by EU regulations, which is necessary to determine the activities within the classes of insurance subject to authorisation (licensing); (b) sets forth the actuarial system; (c) regulates in details undertaking and performance of insurance, reinsurance and insurance mediation activities as well as supervision thereof; (d) introduces the concept of outsourcing operations and transfer of insurance portfolio; (e) provides for prudential standards and risk management rules and mechanisms of insurance undertakings.

Draft Law on Advertisement

     AEPLAC assisted the Working Group leaded by the Ministry of Trade and Economic Development of Armenia in developing a new Law on Advertisement.

 
   
Measures Ensuring the Implementation of Rules of Ethics and Code of Conduct for Public Servants

     AEPLAC has elaborated the report on the “Measures Ensuring the Implementation of Rules of Ethics and Code of Conduct for Public Servants”.
     The report includes the theoretical basis of the subject, the findings of the sample survey as well as recommendations on how to improve the quality of public service in Armenia. The recommendations are based on the system of values and the rules of ethics of public servants in the EU and North American countries. The report also presents the best practices and experience as regards conflicts of interests between a public servant and a state body from the perspective of undertaken measures and introduction of an e-governance system.
